Breeder Guarantee/Sales Contract
This is a legal contract entered into between Breeder and Buyer specified below. This document is the only agreement between Breeder and Buyer. No verbal agreements shall modify this agreement.

In addition to the purchase price, a non refundable deposit of $200 US Dollars is required. This deposit must be sent to the Breeder along with this signed contract to reserve a puppy/dog. This deposit will only be refunded as stated under "Breeder Guarantee".
All payments must be made in the form of a Cashier's Check or Money Order made payable to "Brandi R. Lambert".
Any and all travel and/or shipping charges are not included in the purchase price or deposit. They will be added in addition and must be received with the final payment. The shipping charges will include shipping and/or travel expenses, shipping crate, collar/leash and food/water bowls.
Full purchase price for the puppy and any shipping charges must be made after the puppy has been born but before before the puppy reaches 9 weeks of age. Failure to receive full payment by the time the puppy is 9 weeks of age will forfeit your reservation for a puppy and the puppy will be made available to the next available home. If the puppy or dog is over the age of 9 weeks old when reserved, full payment must be made within 20 days of signing this contract and before delivery of puppy/dog.
Under no circumstances will the puppy leave the premises under the age of 8 weeks old and/or before full payment has been received.

Please read and initial each block below. Note the words "puppy" and "dog" are used interchangeably. Please note that the Breeder Guarantee is null and void if Buyer does not adhere to the following Buyer's Responsibilites.
_____If, at any future time, the Buyer is unable to keep the above described dog, the Buyer must notify the Breeder immediately and return the dog with all registration papers to the Breeder. The dog is not to be sold, given away, destroyed (euthanasia) or placed in an animal shelter. Exception to euthanasia would be in the case of injury or suffering of the dog. Buyer will be required to sign a Surrender Contract at the time of surrender stating that they are forgoing all rights of ownership to said dog and transferring all rights of ownership back to the Breeder.
_____Buyer agrees to provide the Breeder with contact information for a person who has been instructed to contact the Breeder if something should happen to the Buyer (serious injury or death). If Buyer wishes to leave the dog to a person of their choice in the event of something happening to the Buyer, this person needs to be approved by the Breeder at the time the Buyer makes this choice.
_____Every effort has been made by the Breeder to produce a litter both physically and mentally sound. Breeder will stand behind this breeding to the extent stated below. However, Buyer accepts full responsibility for the proper care once the pup leaves the Breeder, as Breeder cannot be held responsible for death, injury, deformity or temperament of the pup due to illness, accident or deviation from adequate care and socialization required for a giant-breed (Anatolian Shepherd Dog) puppy.
_____Buyer will assume responsibility for all transportation and shipping costs. Transportation and shipping is at the risk of the Buyer. Buyer releases Breeder of all responsibility for the pup at the time the pup leaves the Breeder's care prior to transport. As a Buyer, I understand that it is my choice to have the pup shipped and that I am solely responsible for any problems incurred during shipping or after as a result of shipping.
_____Buyer agrees to have this puppy examined by a licensed veterinarian within 10 days of receipt and to provide a copy of the results of that visit to the Breeder. If health problems are found, the puppy along with all registration papers may be returned to the Breeder within 14 days of receipt for a full refund or replacement. Breeder's discretion is used to determine the best arrangement. However, if the Buyer elects to keep the puppy after the required veterinary exam, Breeder is not liable for any existing or future medical conditions except as noted under "Breeder Guarantee" below. Breeder is not resposible for any veterinary expenses incurred by the Buyer.
_____Buyer agrees to continue the vaccination series already started and to arrange for any needed boosters, routine rabies vaccinations and fecal testing/worming. Buyer agrees to provide dog with annual veterinary examinations, as well as appropriate veterinary care, worming, vaccinations and nutrition throughout the dog's life. Buyer is to provide necessary medical treatment in the event of accident/injury to the dog. Annual Heartworm and Lyme testing must be done in areas where this is recommended by the Buyer's veterinarian.
_____Buyer agrees to keep this dog in good condition. Dog shall be maintained at an appropriate weight, shall always have access to clean water and be fed a quality diet, and it shall receive adequate care in regards to coat, ear, nail and dental care. Buyer agrees to provide this dog with adequate protection from natural elements such as heat, cold, rain, snow and pests (such as fleas, ticks, flies, etc.).
_____Buyer agrees to have this dog's hips and elbows x-rayed between 24 and 30 months of age and submitted to an Anatolian Shepherd Dog International approved hip-rating agency for evaluation. Proper positioning for the x-rays is required. The Buyer understands that this is required regardless of whether dog will be spayed or neutered, as it is very important information to our breeding program. Buyer agrees to furnish the Breeder with a copy of the hip and elbow rating certificates prior to the dog turning 3 years of age. Buyer assumes all x-ray and mailing costs. If hip or elbow dysplasia is diagnosed, Buyer agrees to sterilize (spay/neuter) the afflicted dog.
_____Buyer agrees to provide adequate fencing (at least 5 feet high if not a working environment) adjacent to and accessible from the Buyer's home to ensure this dog's safety. This dog shall not be continuously tied or allowed to roam at large.
_____Buyer agrees to provide proper training and socialization for this dog as stipulated by the Breeder. Buyer agrees to complete at least one course in Dog Obedience Training before the dog is one year old. Buyer agrees to provide the Breeder with a letter from the Trainer or certificate indicating proof of successful completion of Dog Obedience Training before the dog is one year old. If the dog is over the age of one year old when placed with Buyer, the Buyer agrees to the same requirements stated above and must complete one course in Dog Obedience Training within 6 months of receiving the dog. Buyer agrees that this dog will not be placed into a facility for "in-kennel training or board and train facilities". Schutzhund training is NOT recommended for this breed. If the Buyer trains or has this dog trained for the sole purpose of teaching this dog to do bite work (i.e. schutzhund, attack, police work and especially dog fighting), all "Breeder Guarantees" offered shall become null and void.
_____Buyer agrees that this dog shall not be subjected to repetitive, nonproductive verbal or physical corrections or other abuse. Dog shall not be subjected to alpha rolls, scruff shakes, gagging, dangle sticks, drags, a shock collar, a choke collar or a pinch collar without consulting the Breeder first before their use. The above may be considered abuse if not used appropriately, and may cause physical and/or emotional damage to the dog. Buyer agrees to consult Breeder with any concerns in regards to behavior or temperament.
_____Buyer agrees to remain in contact with the Breeder throughout the lifetime of the dog. Buyer agrees to provide Breeder with at least one full body photograph and a written health update of the dog each year on or before the dog's birth date. Buyer is to immediately notify the Breeder of any health or temperament problems especially if it concerns a problem that may be of concern to other dogs of that litter. Buyer agrees to keep Breeder notified of any changes in location, e-mail address, telephone numbers and other contact information changes so that the Breeder has updated records in case the Buyer needs to be contacted in the event of an emergency.
_____Buyer agrees that the Breeder has the right to use and/or exhibit any photos taken of this dog on the Breeder's website or for any advertising for Mystic Anatolians.
_____Buyer agrees to submit the official registration applications and fees to both the AKC and UKC within 30 days of receipt of the dog. Buyer agrees to furnish the Breeder with copies of both of the official registration certificates issued by the AKC and UKC within 90 days of receipt of dog.
_____Buyer agrees to license this dog according to the regulations of their county of residence.
_____Buyer agrees to honor any spay/neuter clauses specified in this agreement.
_____Nothing is this agreement shall be construed as liablility on the Breeder's part if the dog shall fail to perform it's intended functions for any reason, nor shall the Breeder be liable for any actions of this dog.
Failure to adhere to these conditions shall void all Breeder Guarantees, unless other arrangements have been made in writing.

Breeder guarantees this dog to be in good health and free of disease upon receipt of Buyer. All dogs will come with a health certificate issued by a licensed veterinarian.
Breeder guarantees that if a licensed veterinarian determines, within 10 days of receipt, that the dog is clinically ill or has died from an injury sustained or illness likely to have been contracted on or before the date of sale and delivery, Buyer may return the dog to the Breeder within 14 days for a full refund or replacement dog of equal value. Breeder's discretion will be used to determine the arrangement.
Breeder guarantees that if within 30 days of receipt, a licensed veterinarian determines the dog has a congenital or hereditary defect which adversly affects the animal's health or that the dog died from a congenital or hereditary defect, Buyer may return the dog to the Breeder for a full refund or replacement dog of equal value. Breeder's discretion will be used to determine the arrangement.
Hip and Elbow Guarantee
Breeder agrees to refund the $200 US Dollar deposit amount upon proof of hip and elbow certification done between 24 and 30 months of age, after Buyer has furnished copies of the hip and elbow rating certificates from an Anatolian Shepherd Dog International approved hip-rating agency to the Breeder by the time the dog reaches 36 months of age.
Breeder guarantees dog to be free of crippling hereditary hip and elbow dysplasia. Breeder must be notified of defect by the time the dog is 32 months of age. Defect must be determined by an Anatolian Shepherd Dog International approved hip-rating agency. Upon proof of defect and proof that the dog has been spayed/neutered, the Breeder agrees to either credit 1/2 the original purchase price towards another dog or refund 1/2 the original purchase price. All claims must be made within 30 days of determination of covered defect.
Breeder guarantees dogs sold under these conditions will meet the qualifications as best as can be determined by 8 weeks of age. If the dog is already an adult, Breeder guarantees that the dog is already displaying these qualities.
Family Companion: This dog is guaranteed to have no serious faults or impairments that would prevent it from being a healthy companion.
Working Livestock Guardian: This dog is guaranteed to have the correct character and temperament to develop into a proper livestock guardian dog. The temperament of an adult dog, however, is a combination of both genetic and environmental factors and cannot be predicted. If the dog is raised with livestock, following the advice of the Breeder and under direct supervision of the Buyer, it should function as a livestock guardian when mature (18-36 months of age). The manner in which the dog is raised directly influences what the dog will protect. Evidence of such function is a lowered rate of livestock loss due to predation and/or lowered evidence of predator activity in the area occupied by the dog. Buyers are strongly encouraged to seek guidance from the Breeder or experienced livestock producers prior to introduction of the dog to the stock.
Show Quality: This dog is guaranteed to have no defects (bad bite, blue eyes, etc.) that would disqualify this dog from being shown in a conformation dog show. However, the Breeder does not guarantee that said dog will win in the show ring, as that depends on the training of the dog, showmanship of the handler and commitment of the owner.
Breeding Quality: Breeder guarantees that this dog has no obvious defects that would prevent it from siring or whelping healthy pups.
In order to be considered breeding quality, the dog must:
- Have hip and elbow certification done by an Anatolian Shepherd Dog International approved hip-rating agency between 24-30 months of age and be certified clear of crippling hereditary hip and elbow dysplasia before breeding.
- Have normal thyroid levels determined upon examination and testing by a licensed veterinarian after reaching 24 months of age.
- Be of good conformation as defined in the official AKC or UKC breed standards.
- Exhibit stable temperament and not be excessively aggressive.
This dog may only be bred to another purebred Anatolian Shepherd Dog that passes all of the criteria listed above.
Further Breeder Guarantees
Breeder guarantees this dog will be microchipped. Breeder will register the microchip under Breeder's name as a safety precaution for the dog. Buyer must notify Breeder of any contact information changes so that Breeder has updated records in case the Buyer needs to be contacted in the event of an emergency. Breeder will furnish the Buyer with microchip number, information and tag. Buyer must license the dog according to the regulations of their county of residence. Microchip should be scanned by a licensed veterinarian in order to be supplied with the correct paperwork to license the dog in their county of residence.
Breeder will litter register the pups with the AKC and UKC.
AKC Registration - Breeder will supply the Buyer with the official AKC application to be filled out and submitted to the AKC by the Buyer after a name has been chosen for the puppy. Breeder will fill in the chosen name for the dog. This is to ensure the proper kennel name will be used in the registered name.
UKC Registration - Breeder will supply the Buyer with the official UKC application to be filled out and submitted to the UKC by the Buyer after a name has been chosen for the puppy. Breeder will fill in the chosen name for the dog. This is to ensure the proper kennel name will be used in the registered name.
Breeder will supply the Buyer with the following when the puppy leaves:
- A bag of dry puppy food that the puppy has been started on. Please note: This will only be provided to those Buyers who pick up the puppy in person. This will not be shipped.
- Health certification issued by a licensed veterinarian.
- Health Record of worming/vaccinations already administered to puppy.
- Copies of Dam and Sire's OFA rating certificates.
- Pedigree of litter
- Puppy information kit
THE BREEDER GUARANTEES ARE NULL AND VOID IF:
- This dog has been used for breeding prior to hip and elbow certification by an Anatolian Shepherd Dog International approved hip-rating agency and copies of the certificates being provided to the Breeder.
- This dog has been used for breeding if the hip and elbow certification show abnormal hip or elbow results.
- This dog has been used for breeding before 24 months of age.
- This dog was bred to a dog other than a purebred Anatolian Shepherd Dog.
- The Buyer did not fulfill all of the requirements as listed under "Buyer Responsibilities".
- The Buyer did not fulfill the spay/neuter agreement for those dogs being placed on a spay/neuter contract in the allotted time frame as stipulated by Breeder.
- This dog was sold on a spay/neuter contract and was bred before being spayed/neutered.
- This dog was subjected to abuse, poor nutrition, inadequate training and/or veterinary care.

This dog is being sold under a spay/neuter contract with "Limited Registration". This dog must be spayed/neutered between 6 and 24 months of age. This dog is NOT to be spayed/neutered any younger than 6 months of age. However, the spay/neuter procedure must be done BEFORE the dog reaches it's second birthday.
- Buyer agrees to spay/neuter this dog in the time specified by Breeder.
- Buyer agrees to provide Breeder with a signed certificate from a licensed veterinarian verifying that the sterilization procedure has been performed.

If Buyer fails to adhere to the terms set forth in this agreement, all "Breeder Guarantees" in this contract are null and void.

Further Contractual Agreements
1. Breeder will refund the deposit of $200 US Dollars if Breeder is unable to place a puppy/dog with Buyer.
2. Breeder reserves the right to refuse a puppy/dog to said Buyer, for any reason, up until the time the puppy/dog has been delivered to Buyer.
3. Each puppy's registered name is to begin with "Mystic's" followed by the chosen name of the puppy.
By signing below, all parties agree to the terms of this document and agree that this is a legal binding contract and cannot in any way be countermanded.
